Welcome to Zeka Vineyards! We’re so glad you’re here. Before you browse our wines, join our Wine Club, or reach out to us, please take a few minutes to read through these Terms & Conditions (“Terms”). They explain the rules of the road for using our website and doing business with us.
By using zekavineyards.com (the “Site”), placing an order, or joining our Wine Club, you agree to these Terms. If you don’t agree with something here, please don’t use the Site — and feel free to contact us directly with any questions.
1. Who We Are
Zeka Vineyards is a boutique, single-vineyard winery located in the Bennett Valley AVA, Sonoma County, California.
- Business/Mailing Office: 1110 Burlingame Ave, Ste 211, Burlingame, CA 94010
- Vineyard & Tasting Location: 5377 Bennett Valley Road, Santa Rosa, CA 95405
- Phone: 707-582-1228
- Email: As listed on our Contact Us page
Throughout these Terms, “we,” “us,” “our,” and “Zeka Vineyards” refer to Zeka Vineyards. “You” refers to anyone visiting or using our Site.
2. You Must Be 21 or Older
We sell wine. That means, by law, everyone using this Site — browsing, purchasing, or joining our Wine Club — must be 21 years of age or older. That’s why you’ll see an age verification prompt when you enter our Site.
By confirming your age, you’re legally representing to us that you are 21+. If we discover an order was placed by someone under 21, or intended for someone under 21, we reserve the right to cancel that order immediately without notice.
We also require an adult signature (21+) upon delivery for all wine shipments. If no one of legal age is available to sign, the shipping carrier may return the package to us, and any resulting redelivery or restocking costs may be passed on to you.
3. Shopping & Orders
- All wine purchases are processed through our secure third-party ecommerce and wine club platform. When you check out, you’re briefly leaving zekavineyards.com and entering that provider’s secure environment — they handle payment processing on our behalf. We do not store your full payment card details on our own servers.
- Prices for our wines are listed in US Dollars and are subject to change without notice, though we’ll always honor the price shown at the time you complete your order.
- We reserve the right to limit quantities, refuse, or cancel any order — for example, if we suspect fraud, if a product listing had a pricing error, or if we’re unable to legally ship wine to your location.
- Once an order ships, you’ll typically receive a confirmation with tracking information.
Shipping Restrictions
Alcohol shipping laws vary significantly from state to state (and even country to country). We can only ship wine to states and jurisdictions where it is legal for us to do so. If your shipping address is in a location we cannot legally ship to, we’ll let you know and cancel/refund that portion of your order.
Damaged or Lost Shipments
Wine is a delicate, temperature-sensitive product. If your order arrives damaged, or doesn’t arrive at all, please contact us within 7 days of the expected delivery date so we can make it right — whether that’s a replacement or a refund, handled case by case.
4. Wine Club Membership
Our Wine Club (Calera, Pommard, and Dijon tiers) is a recurring membership program. By joining, you’re agreeing to the following:
- Recurring Shipments & Billing: Depending on your tier, you’ll automatically receive a set number of bottles per year (e.g., 12 for Calera, 6 for Pommard, 3 for Dijon), and your payment method on file will be charged automatically for each shipment at the time it ships.
- Membership Discounts & Perks: Member discounts, free tastings, and other perks listed on our Wine Club page apply only while your membership is active and in good standing.
- Cancellation: You may cancel or pause your membership at any time by contacting us directly or through your account on our ecommerce platform. Cancellations must generally be made before a shipment processes to avoid being charged for that shipment — we recommend reaching out a few days ahead of your expected ship date.
- Changes to the Program: We may occasionally update Wine Club pricing, benefits, or shipment schedules. We’ll do our best to notify active members of any material changes.
- Pick-Up Only Tiers: Some tiers (such as Dijon) are pick-up only and are not eligible for shipping. It’s your responsibility to arrange pick-up within a reasonable time; unclaimed wine may be subject to our discretion.
5. Website Content & Intellectual Property
Everything on this Site — text, photos, our logo, vineyard imagery, wine descriptions, and design — belongs to Zeka Vineyards or is used with permission, and is protected by copyright and trademark laws.
You’re welcome to browse, share links to, and enjoy our content personally. But please don’t copy, reproduce, republish, or use our content (including our photos or wine descriptions) for commercial purposes without asking us first.
6. Accuracy of Information
We work hard to keep vintage details, tasting notes, awards, pricing, and availability accurate and up to date. That said, wine is a living, evolving product — vintages sell out, award details get updated, and occasional errors happen. We don’t guarantee that every piece of information on the Site is 100% error-free at all times, and we reserve the right to correct errors, including pricing errors, even after an order has been placed.
7. Third-Party Links & Services
Our Site may link out to third parties — our social media pages, our secure checkout/wine club platform, or partner businesses (like our tasting-room and event partners). We don’t control those third-party sites and aren’t responsible for their content, policies, or practices. We’d encourage you to review their own terms and privacy policies before engaging with them.
8. Private Tastings & Events
If you book a private tasting or event with us, additional terms specific to that booking (such as deposits, cancellation windows, and guest limits) may apply and will be communicated to you directly at the time of booking. These Terms apply in addition to, not in place of, any such event-specific agreement.
9. Limitation of Liability
To the fullest extent permitted by law, Zeka Vineyards, its owners, and staff won’t be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products — this includes things like shipping delays caused by carriers, temperature-related wine spoilage in transit, or website downtime.
Nothing in these Terms limits any rights you may have as a consumer that cannot be excluded under California or applicable law.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes will be handled in the appropriate state or federal courts located in California.
11. Changes to These Terms
We may update these Terms from time to time — for example, as our Wine Club program evolves or as laws change. When we do, we’ll update the “Last Updated” date at the top of this page. Continuing to use the Site after changes are posted means you accept the updated Terms.
